Terms of Service

Thanks for using GNCloud! These terms and conditions are an agreement between yourself and Glimpse Networks INC. and govern your use of the GNCloud service. Please let us know if you have any questions about our terms and conditions ("Terms"). Our Terms were last updated on April 21st 2018. We may update our Terms from time-to-time. If we do so, we'll be sure to let you know via email. Your continued access to or use of GNCloud after such changes indicates your acceptance of these Terms as modified.

GNCloud PRODUCTS AND SERVICES SUPPORT BACKUP STORAGE TO MULTIPLE LOCATIONS UTILIZING BOTH LOCAL AND REMOTE STORAGE. GNCloud STRONGLY ADVISES AND ENCOURAGES YOU TO LEVERAGE THE FULL CAPABILITIES OF THE GNCloud PRODUCTS AND SERVICES AND BACKUP YOUR DATA TO AT LEAST TWO DESTINATIONS AND TO UTILIZE BOTH LOCAL AND REMOTE STORAGE FOR ADDITIONAL REDUNDANCY AND PROTECTION OF YOUR USER DATA.

USER DATA

While there is no current limitation for GNCloud subscribers on the amount of User Data backed up to remote storage owned by GNCloud, GNCloud reserves the right in the future, in its sole discretion, to set commercially reasonable data storage limits (i.e., 1TB) on all GNCloud accounts.

The content stored on GNCloud is protected by intellectual property laws. You can back up your own files on GNCloud. The materials you upload to GNCloud are yours and yours alone. You give us permission to use that material solely to do what's necessary to provide our services, including storing, displaying, reproducing, and distributing those materials. We don't sell your materials to third parties, and we don't use them for advertising purposes.

You're solely responsible for the files you upload to GNCloud and assume all risks associated with them, including intellectual property or other legal claims. By storing files on GNCloud, you represent that you have the necessary rights to that material, and that doing so doesn't conflict with any licenses you've granted to others.

Please be careful about what you choose to share. GNCloud doesn't actively monitor the files you upload. However, we have the right to remove files you store with GNCloud for any reason (such as copyright infringement, we learn the material is patently unlawful, etc.) We assume no liability for any content that you or anyone else stores with GNCloud.

GNCloud is protected by copyright, trademark, and other laws. GNCloud gives you a personal, worldwide, royalty-free, non-assignable and non-exclusive license to use the software we provide you to use our service. This license is for the sole purpose of enabling you to use GNCloud as permitted by these Terms. If you violate these Terms, we may terminate this license.

All rights to GNCloud—except third-party content—are the exclusive property of GNCloud and its licensors. Nothing in these Terms authorizes you to use any of GNCloud trademarks, logos, domain names, or other distinctive brand features except as otherwise permitted by law.

Prohibited Use of the Service

GNCloud strives to maintain a great service. To that end, we require you to respect these limitations, and we may terminate your account if you don't follow them.

  • Don't use GNCloud in a manner that violates any laws, regulations, ordinances, or directives.
  • Don't use GNCloud contrary to our policies.
  • Don't use GNCloud to do anything threatening, abusive, harassing, defamatory, tortious, or invasive of another person's privacy.
  • Don't interfere with the proper functioning of any software, hardware, or equipment on GNCloud.
  • Don't engage in any conduct that inhibits anyone else's use or enjoyment of our services, or which we determine may harm GNCloud or our users.
  • Don't monitor or copy any material on GNCloud, either manually or through automated means (i.e., scraping), without prior written consent.

Our Rights

We're always working to improve GNCloud and make our services better, so we do reserve some rights. In our sole discretion, we may, at any time—with or without notice—change, eliminate or restrict access to our services, and modify, suspend, or terminate a user account. GNCloud is not liable for any damages as a result of these actions.

Other Site and Service

GNCloud may contain links to websites, services, and advertisements that we neither own nor control. We don't endorse or assume responsibility for any third-party sites, information, materials, products, or services.

Privacy

Our Privacy Policy governs our collection and use of your personal information. Please review those provisions, too.

Cancellation

You can cancel your account any time. Just send us an email to support@glimpsenetworks.ca

Billing and Refunds

Recurring Billing

GNCloud will automatically send you an invoice each month, or year depending on the plan for which you signed up. For 1-year plans, we will attempt to send an email ahead of time to remind you that your renewal is coming up. However, we cannot be responsible for emails that have not been received.

No Refunds on Monthly Plans

The free trial is designed to let you experience the service. If you sign up for a monthly subscription, you are welcome to cancel at any time, but we cannot issue any refunds.

Refunds on 1-Year Plans

The free trial is designed to let you experience the service. However, if you sign up for a 1-year plan and decide to cancel, you can request a full refund up to 30 days after subscribing to the service.

Charge Disputes

If you have any dispute regarding charges to your account, you have 30 days from the date of the charge to dispute it. Please contact our support team regarding any questions concerning a charge, support@glimpsenetworks.ca.

Cancelling Service

To cancel your subscription, please contact us at support@glimpsenetworks.ca

User data will be retained for 30 days before it is permanently deleted. An extension of an additional 60 days may be granted should GNCloud staff deem it necessary.

Unpaid Accounts

If GNCloud is unable to re-bill your account during a renewal, computers on your account will stop backing up. Continued non-payment will result in your backed up data being deleted.

Disclaimer and limitation of liability

THE GNCloud WEBSITES (LOCATED AT https://*.glimpsenetworks.ca/) AND SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTY OR CONDITION OF ANY KIND. USE OF GNCloud IS AT YOUR OWN RISK. GNCloud DOES NOT MAKE ANY REPRESENTATIONS, WARRANTIES OR CONDITIONS ABOUT THE QUALITY, ACCURACY, RELIABILITY, COMPLETENESS, CURRENCY, OR TIMELINESS OF THE GNCloud WEBSITE OR THE GNCloud SERVICE. GNCloud DOES NOT ASSUME ANY RESPONSIBILITY FOR ANY ERRORS, OMISSIONS OR INACCURACIES IN THE GNCloud WEBSITE OR THE CONTENT.

TO THE FULLEST EXTENT PERMITTED BY LAW, GNCloud DISCLAIMS ALL WARRANTIES, REPRESENTATIONS AND CONDITIONS OF ANY KIND WITH RESPECT TO THE GNCloud SERVICE WHETHER EXPRESS, IMPLIED OR COLLATERAL, INCLUDING, WITHOUT LIMITATION, THE IMPLIED WARRANTIES AND CONDITIONS OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT OR THAT THE SITE OR THE CONTENT ARE OR WILL BE ERROR-FREE OR WILL OPERATE WITHOUT INTERRUPTION. IN NO EVENT WILL GNCloud BE LIABLE, WHETHER BASED ON WARRANTY, CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY OR ANY OTHER LEGAL THEORY, FOR ANY DAMAGES OR ANY KIND (INCLUDING, WITHOUT LIMITATION, DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, PUNITIVE DAMAGES, LOST PROFITS, LOSS OF USE, LOSS OF DATA, PERSONAL INJURY, FINES, FEES, PENALTIES OR OTHER LIABILITIES), WHETHER OR NOT GNCloud IS ADVISED OF THE POSSIBILITY OF SUCH DAMAGES, RESULTING FROM THE USE OF, OR THE INABILITY TO MAKE USE OF, THE GNCloud WEBSITE OR THE SERVICE.

Entire Agreement

These Terms and our Privacy Policy constitute the entire agreement between you and GNCloud If any provision of these Terms is found to be unenforceable, the remaining provisions of these Terms will remain in full force and effect.

No Waiver

No waiver of any provision of these Terms shall be a further or continuing waiver of that term. GNCloud's failure to assert any right or provision under these Terms does not constitute a waiver of that right or provision.

Governing Law & Jurisdiction

This contract is a legal document under exclusive jurisdiction of courts in the Province of British Columbia, Canada.
